www.mditaly.it is a Service developed and provided by MD Italy by Mazzocchitti Dino, with registered office at Zona Industriale Piane sant’Andrea snc, 64032 Atri (TE).
www.mditaly.it allows registered and non-registered Users to freely visit the online store, as well as view articles and prices, have a wishlist, and a cart to temporarily store selected items, and use basic services without the need to provide their personal data.
For the use of advanced services and to make purchases, registration with our community is required by entering personal data in compliance with European Regulation 2016/679 and Legislative Decree 196/2003 (Privacy Policy).
TERMS OF USE
These Terms of Use govern access, navigation, and use of the website www.mditaly.it (hereinafter also referred to as the Site), as well as the provision and enjoyment of the various contents and Services available therein, including tools, functions, applications, data, software, players, and apply to all visitors and/or users who access it, whether registered users or not (Users).
By browsing the Site and using the contents and Services available therein, the User acknowledges that they have read, understood, and accepted these Terms of Use, which they undertake to comply with.
Therefore, Users are invited to carefully and fully read these Terms of Use before using the Site and its functionalities and, if they do not agree with any of the terms and conditions contained therein, to abandon browsing the Site.
These General Terms of Use apply both to consumers in compliance with the Consumer Code Legislative Decree 206/2005 and its subsequent amendments, and to entrepreneurs, professionals, and other economic entities, unless it is expressly established that specific rules apply only to certain categories of subjects. Pursuant to current legislation (art. 3 of Legislative Decree 206/2005), it is reminded that the "consumer" is the natural person who acts for purposes unrelated to any entrepreneurial, commercial, craft, or professional activity that may be carried out.
All data is collected, stored, and used in accordance with the Privacy Policy; therefore, it is necessary to ensure that you have read and understood said policy. www.mditaly.it uses cookies, which allow analysis of how people use the Site, in order to improve the Services offered. The User will find all information regarding the use of cookies by mditaly.it in the Cookie Policy.
The use of the Site is strictly personal. The use of the Site is undertaken by the User at his/her own risk.
The User acknowledges that the entire content of the Site - including, but not limited to, text, software, music, sound, photographs, videos, graphics, or other - is protected by copyright, patents, or other proprietary rights and by specific legal provisions.
MD Italy by Mazzocchitti Dino is in no way responsible for damages or any loss of profit caused to the User or third parties by accessing, browsing, and using the Site.
All information, content, materials, and software accessible through the Site are provided "as is" and "as available".

To the fullest extent permitted by applicable law, MD Italy by Mazzocchitti Dino will not be liable in any event for any claims, costs, demands, damages, losses, expenses, or other liabilities of any nature arising from the use or inability to use the Site, including any compensatory, incidental, direct, indirect, special, punitive, or consequential damages, or for loss of use, loss of data, loss of income or profits, loss of goods or damage to property, third-party claims, losses caused by reliance on the Content, information, websites, software, or products obtained through the Site owned by MD Italy by Mazzocchitti Dino, or for errors, omissions, interruptions, incorrect communications, deletions of files or emails, problems, defects, viruses, trojans, delays in operation or transmission, or any other performance issues, theft, destruction, or unauthorized access to records, programs, or websites, or other losses of any kind or nature related to the use of the Site www.mditaly.it, even if advised of the possibility of such damages or losses arising from or connected to their use or that of any other website or linked platform. The website www.mditaly.it offers a comprehensive e-commerce service in the educational, audio-visual, and stage equipment world. As for the payment and delivery methods provided, the User can consult the appropriate page by clicking here.
The Service may contain links to third-party websites and online services not owned or controlled by MD Italy di Mazzocchitti Dino. Since MD Italy di Mazzocchitti Dino has no control over such websites and online services, it assumes no responsibility for them, directly or indirectly, for any damages or losses actually or presumably caused by or in connection with the use or reliance on content, goods, or services available through third parties or otherwise published by third parties on the Site. Similarly, the inclusion of links to third-party sites on the Site does not imply that the owners of such sites have provided authorization for this inclusion, nor does it imply that they endorse or support the Site. The User may not in any way disseminate or reproduce the content of the Site or use it differently from what is authorized by the Service.
The User agrees not to use the Site for the following purposes:
a) send via email or otherwise transmit content that somehow violates these Terms of Use;
b) impersonate another person or entity or provide false or otherwise incorrect statements regarding the relationship with a person or entity, for example, by using another person's login credentials;
c) send via email or otherwise transmit unsolicited or unauthorized promotional or advertising materials, spam, chain letters, "pyramid schemes," or other forms of solicitation;
d) use or attempt to use "deep-link," "scraper," "robot," "bot," "spider," "data mining," "computer codes," or any other process or methodology, algorithm, tool, program, or device automated, or manual process with similar functionality or procedures, to access, acquire, copy, or monitor parts of the Site or any other material from mditaly.it without having obtained express written authorization from the same;
e) obtain or attempt to obtain, by any means, User content, or any other data, content, software, or code available on the Site that has not been unequivocally made available to the public or accessible via a link;
f) violate systems to limit or prevent access to the Site or its contents;
g) violate the protection of the Site or attempt to gain unauthorized access to the same sites/platforms, their contents, or the networks or computer systems connected to the services of the Websites and/or platforms, through acts of hacking, misappropriation of passwords, or any other means;
h) interfere with or attempt to interfere with the proper functioning of the Site or any activity conducted on or through it, including access to content before it is made available to the public;

It is not permitted to perform any work of software study of the Service for any reason (or allow third parties to do so), copy or adapt (or allow third parties to copy or adapt) the object code of the Site or any Service, disassemble, decompile, modify, or attempt to discover any source code, fraudulently use the Service.
NON-REGISTERED USERS
Users can access the Site and freely browse the online store, view items and their prices, temporarily add selected items to the cart, and use the basic services offered by the Site. Non-registered users, when using the Site, cannot make purchases.
ACCOUNT ON WWW.MDITALY.IT - REGISTERED USERS
In order to fully benefit from the Site's features and the content and services available therein, it is necessary for the user to register on the Site by completing all parts of the registration form. By clicking the "Create your account" button, the user declares to have accepted the present Terms of Use of the Site.
Registration of users who have been previously suspended or removed from the Site is not allowed.
The user guarantees the accuracy, completeness, and truthfulness of the data and information provided to MD Italy di Mazzocchitti Dino during registration, as well as all information and data provided during the use of the Site and the content and services available therein.
MD Italy di Mazzocchitti Dino shall have the right, at its sole discretion, not to accept the user's registration, or to suspend or terminate - even permanently - access to the Site and/or the provision of services, if any user information should prove to be wholly or partially false, incomplete, or inaccurate. Access credentials (username and password) cannot be shared with others or in any way disclosed to third parties. The user is responsible for all uses of the Site. The user is responsible for protecting and safeguarding their password from unauthorized use and disclosure.
MD Italy di Mazzocchitti Dino reserves the right to suspend, at its sole discretion, temporarily or permanently, the accounts of registered users, in whole or in part, from using the Service, if their behavior violates these Terms of Use without MD Italy di Mazzocchitti Dino incurring any obligation to compensate the suspended users. MD Italy di Mazzocchitti Dino reserves the right to modify, suspend, or terminate, in whole or in part, the services offered, even without notice.
MD Italy di Mazzocchitti Dino is not responsible for transport and delivery times by carriers, which are the sole responsibility of the carriers, as well as for any damages caused during transportation. Quality control of the products to be shipped is carried out upstream, and in any case, it is always possible to contact customer service.
COMMUNICATIONS
MD Italy by Mazzocchitti Dino may send communications to the User via email, publications on the Technical Support Website and/or by conventional mail. For any request, assistance or complaint, the User may contact MD Italy by Mazzocchitti Dino, owner of the website www.mditaly.it by sending an email to customer service (info@mditaly.it).
MISCELLANEOUS
In the event that any clause of these Terms of Use is declared invalid or inapplicable for any reason by a court of competent jurisdiction, the remainder of the Terms of Use will remain valid and enforceable according to their respective terms.
The content of these Terms of Use cannot be modified by the behavior of MD Italy by Mazzocchitti Dino or the User, even if repeated, nor by any procedure or habit of third parties involved in the same or similar activities. In addition to being an integral and substantial part of the registration form, these Terms of Use are available on the website www.mditaly.it at the link "Terms of Use" and can be consulted at any time.
LAW AND JURISDICTION
These General Conditions of Use are governed by and must be interpreted and applied in accordance with the laws in force in the territory of the Italian Republic.
Except where the user is a consumer, the sole competent judge for all disputes arising in connection with the execution of these General Conditions of Use is that of the Court of Teramo, competent based on the registered office located in Via Cesare Beccaria 1 64100 - Teramo.
If the User is a consumer, the competent judge remains that provided for by Legislative Decree 206/2005.
PAYMENT AND SHIPPING
Payment
The payment methods currently available are:
• Credit Card: all cards from the Visa, Visa Electron, Mastercard, Postepay, Diners, JCB circuits are accepted (for payments with American Express, please use the PayPal method) and you can pay with the MasterPass circuit. All transactions are secure and credit card data will be sent through a secure SSL connection. In some cases, to carry out anti-fraud checks and therefore for the security of mditaly.it and the cardholder, a copy of an identity document of the buyer and the credit card with the obscured digits (excluding the last 4) and the expiration date may be required.
• Cash on Delivery, with payment in cash to the courier upon delivery of the package (bank checks are not accepted) for purchases under 500 euros. The service cost is € 5.90. Bank checks are not accepted.
• Bank Transfer, a secure method now widely used, also thanks to the possibility of making the payment directly online and in many cases without expenses. The coordinates to make the payment will be provided at the end of the purchase process in the order summary email. ATTENTION: The order will be processed only after receipt of payment (it takes from 1 to 5 days from execution).
• Agreed with the management. For already customers of MD Italy by Mazzocchitti Dino who enjoy payment methods different from those listed above but who wish to use www.mditaly.it for future purchases, it will be possible to maintain it upon approval by the Management.
• PayPal, a payment method that allows anyone with an email address to send and receive payments online easily, quickly and securely. By creating a PayPal account, you enter your credit card only once and you can confidently pay for your online purchases without having to type it again in every transaction. Therefore, credit card data is processed exclusively by PayPal.
Shipping
Shipping costs vary depending on the destination address and the total weight of the items in the cart and are calculated automatically during the purchase procedure. The calculation takes into account both the actual weight and the size of the packaging and takes into account any pallets used to transport the goods safely.
In case of high amounts or bulky items, it is possible to agree on different shipping methods or to insure the goods by contacting our Customer Service or writing to logistica@mditaly.it.
Together with the packaging(s) containing the purchased items, the customer will receive the transport document related to them. The sales invoice will be delivered through the electronic invoicing system by the 10th of the month following the purchase date.
For shipments by courier, the shipping amount will be charged on the invoice or substitute. In any case, the shipping costs are considered due and payable by the customer, even if the same exercises the right of withdrawal pursuant to the following paragraph, or refuses and returns to the sender, for any reason, the goods regularly ordered. The shipping costs for the return of the goods to our warehouse are in any case entirely borne by the customer. In this case, the customer must refund the aforementioned shipping costs, and possibly, in case of non-payment of the same, MD Italy by Mazzocchitti Dino will resort to legal means for the recovery of the aforementioned credit.
If the customer has their own subscription with the courier, they can choose the "assigned port" method. This method is subject to approval by MD Italy by Mazzocchitti Dino. In case of approved method, the transport costs will not be charged on the sale as the withdrawal of the goods will be arranged by the customer himself. The withdrawal of the goods must take place at our plant located in Zona industriale Piane sant’Andrea snc, 64032 Atri (TE). The withdrawal of the goods can only be arranged after the payment of the same according to the previously illustrated methods.
Invoice Request
The courtesy invoice can be requested from our accounting office, by email at the address info@mditaly.it, within 10 days from the payment of the order.
Order Cancellation
Orders are binding and can only be canceled if the goods have not yet been shipped, necessarily by opening a ticket in your "My orders" section. For orders already shipped, the customer must exercise the Right of Withdrawal.
Attention: the times indicated for delivery times are indicative and are absolutely not binding for the company MD Italy by Mazzocchitti Dino.
It is possible to check the status of the shipment online by accessing the site with your email and password and going to the My orders section.
ITEM WARRANTY
Items purchased on mditaly.it are NEW and therefore come with a warranty in accordance with Italian law pursuant to Legislative Decree no. 206/2005 (consumer code).
Warranty refers to the free repair or replacement of components or parts of the device recognized by the respective manufacturers as defective in manufacturing or material. The warranty does not cover accidental damage or damage resulting from loss, failure to use the item, damage caused by loss of information stored by the customer in any form. Furthermore, no responsibility is assumed for any damages that may directly or indirectly result to persons, property, or animals as a result of failure to observe the prescriptions indicated in the respective operating manuals and concerning, especially, warnings regarding INSTALLATION, USE AND MAINTENANCE OF THE DEVICE.
The WARRANTY is recognized to those buyers who present the original purchase invoice together with the item for which repair is being requested.
For consumers, i.e., those who purchase for purposes unrelated to their professional or entrepreneurial activity, Legislative Decree no. 206 of September 6, 2005 (two years under legal conditions) will apply;
For other buyers, who usually purchase with VAT number, the legal warranties referred to in articles 1490 and following of the Italian Civil Code will apply (one year under legal conditions).
Any extensions of the warranty issued directly by the manufacturer are always reserved.
WARRANTY TERMS
The warranty is valid for the indicated period, starting from the date of the invoice, on all parts of the item not subject to wear and tear for malfunctions attributable to manufacturing defects.
The warranty DOES NOT APPLY to damage caused by carelessness, incorrect use and installation NOT IN CONFORMITY with the warnings and instructions reported in the instruction or installation manual, from improper use, mistreatment, deterioration, lightning, atmospheric phenomena, overvoltages and overcurrents, insufficient or irregular power supply, adaptation or modification, nor to damage caused by incorrect use or in CONTRADICTION WITH THE TECHNICAL AND/OR SAFETY MEASURES REQUIRED IN THE COUNTRY WHERE THE DEVICE IS USED.
If, during the warranty period, one or more parts are replaced for repair with part or parts not authorized by the respective manufacturers, or not responding to the appropriate safety and quality measures for the same, or if the repair is carried out by UNAUTHORIZED personnel, the buyer loses the right to repair.
Consumable parts considered subject to normal wear and tear or wear and tear, such as rubber inserts, sliding parts, threads, steel cables, or components subject to movement or friction, are EXCLUDED from this warranty.
AFTER-SALES SERVICE

REPLACEMENT OF NON-FUNCTIONING DELIVERED ITEM (DOA)
The DOA (Dead On Arrival) procedure can be activated when the purchased component does not work from the first use.
This Warranty can be exercised by communicating the problem within 2 days of receipt of the goods.
The service activation can be done by contacting our Customer Service.
Once activated, the Customer Service of www.mditaly.it will propose to the Customer, based on the availability of the DOA item at that time, the replacement of the defective component or the issuance of a Credit Note with a concurrent bank transfer to the Customer's bank account. The amount of any credit note and bank transfer will be calculated taking into account any discounts and promotions present in the purchase invoice and in any case the replacement of the item will take place within 60 days from the opening of the practice.
The defective item must be shipped by courier to the address that Customer Service will indicate to you. Transportation costs will be borne by www.mditaly.it. The goods subject to DOA must be returned using a rigid box that contains the original packaging (except for authorized exceptions; e.g., very bulky packages); which must be ABSOLUTELY:
- free from any writing or tear
- complete with all the material included
- complete with internal protections to preserve its good condition during transportation
In the absence of the above conditions, the goods will be returned to the customer at his expense and it will not be possible to implement the DOA service.
REPLACEMENT OF ITEM DUE TO WRONG SHIPMENT
In case you receive an item not ordered, or ordered but delivered to a shipping address different from the one indicated during order confirmation, please contact our offices at the address logistica@mditaly.it to agree on the return procedures for the first case or a new attempt to deliver to the correct address in the second case.
ITEM INCOMPLETE WITH SOME PARTS OR MATERIAL INCLUDED
In case the item is missing some parts or material included, the user must communicate it to Customer Service requesting the sending of the missing parts. This Warranty can be exercised by communicating the problem within 2 days of receipt of the goods. Customer service may request photos or additional information attesting to the lack of said parts.
In case of approval by Customer Service, MD Italy by Mazzocchitti Dino will send the missing parts or missing material. Any shipping costs will be borne by MD Italy by Mazzocchitti Dino.
The management reserves the right not to approve the request in case the information provided in the communication is found to be insufficient or not convincing, or if the communication itself is received beyond the previously indicated deadlines. In this case, the customer can make a request to purchase the missing components: the request will be considered as a new purchase, with the costs of the components and shipping costs borne by the buyer.
DAMAGE TO THE GOODS DURING HOME DELIVERY
Always check the condition of the packaging when the goods are delivered. If there are any damages, even slight, write "accepted with reservation" on the courier receipt. It is recommended to take photographic documentation of the damaged packaging and send it to logistica@mditaly.it. The same photos will be kept as proof in case of insured shipments to request reimbursement. Before proceeding to open the packaging to check the condition of the products contained therein, we recommend contacting our logistics service at the address logistica@mditaly.it for instructions on how to proceed.
RIGHT OF WITHDRAWAL
Purchases on our website are subject to the discipline of Legislative Decree no. 206/2005 (Consumer Code), which governs distance contracts, in cases where the delivery of the goods takes place at the buyer's domicile or indicated location, as these purchases are concluded outside of commercial premises.
The importance of the aforementioned legislation lies in the provision of the right of withdrawal to the buyer.

WHAT DOES IT CONSIST OF?
The consumer has the right to withdraw from the contract within the conventional period of 15 days from the receipt of the goods, by returning the goods subject to withdrawal to the seller. It is specified that in cases of premium operations (so-called promotions), where the purchase of one item is combined with another item sold at a ridiculously low price or even given away, the right of withdrawal will be legitimately exercised by returning both items purchased, given the accessory nature of the promotional item compared to the first one.
CAN I EXERCISE THE RIGHT OF WITHDRAWAL?
The regulations provide that the right of withdrawal can only be exercised by individuals (consumers) acting for purposes that can be considered unrelated to their commercial activity. Therefore, the right of withdrawal cannot be exercised by legal entities and individuals acting for purposes related to a commercial activity. Purchases made by resellers or by individuals who purchase for resale to third parties are also excluded from the right of withdrawal. WHAT DOES IT INCLUDE? MD Italy by Mazzocchitti Dino will refund all payments relating to the order subject to withdrawal received from the consumer, possibly including delivery charges net of additional costs. However, the consumer will bear the direct cost of returning the goods. MD Italy by Mazzocchitti Dino may withhold the refund until it has received the goods or until the consumer has demonstrated that they have returned them, depending on which situation occurs first. The consumer must return the goods without undue delay and in any case within 14 days from the date on which they communicated their decision to withdraw from the contract. The deadline will be deemed to have been met if the consumer returns the goods before the expiry of the 14-day period. The consumer will be responsible for any decrease in the value of the goods resulting from handling other than that necessary to establish their nature, characteristics, and functioning.
WHAT DOES IT EXCLUDE?
The right of withdrawal does not apply to items made to the consumer's specifications or clearly personalized or to sealed goods that are not suitable for return due to health protection or hygiene reasons.
HOW DO I EXERCISE THE RIGHT OF WITHDRAWAL?
The following components, documents, and data must be available:
- unused and intact original packaging of all its parts
- original invoice
- in the case of partial withdrawal, in addition to the purchase invoice, the article(s) code(s)
At this point, you can contact the Customer Service of www.mditaly.it, which will inform you of the procedure to follow to open the withdrawal procedure, giving you authorization for the return of the components at the same time. The procedure is summarized below: Sending a communication containing a statement of wanting to exercise the right of withdrawal, indicating all the required data: order number, invoice number, email address with which you registered, which items must be subject to withdrawal (identifying them by article code).
HOW DO I MAKE THE "RETURN" SHIPMENT TO MD Italy?
1. After activating the withdrawal procedure, it is necessary to place the original packaging containing the goods in a suitable package, in order to protect the original packaging of the items from any damage, writing, or alteration. MD Italy by Mazzocchitti Dino reserves the right to refuse the goods received if the above procedure is not followed.
2. The goods must be returned, at your own expense, within 10 days of the return authorization communicated by our after-sales service (art. 67 Legislative Decree no. 206/2005), to the following address: MD Italy by Mazzocchitti Dino, Zona industriale Piane Sant’Andrea snc, 64032 Atri (TE).
Note: It is advisable to use a courier or other suitable means of shipment that allows the shipment to be tracked. It is understood that MD Italy by Mazzocchitti Dino will not proceed with the refund of the goods subject to withdrawal if it does not receive the corresponding delivery.
HOW LONG DOES THE REFUND TAKE?
MD Italy by Mazzocchitti Dino will make the credit to the Customer within 14 days of receiving the goods.
WARNINGS
MD Italy by Mazzocchitti Dino reserves the right not to accept shipments of components or items that:
- do not contain original packaging, accessories, and manuals;
- have been made without activating the request for intervention to the Customer Service of www.mditaly.it;
- have been made without following the shipping methods indicated by the Customer Service of www.mditaly.it.
In such cases, the transport costs relating to both the shipment and the return will be borne by the customer.
